Our Terms

Upon signing up for TBS Web Design services, all customers agree to comply with TBS Web Design Terms & Conditions. The spirit of this policy is to ensure our customers are using TBS Web Design services with due regard to the rights of other Internet users and in conformity with the requirements of the TBS Web Design network environment.

Please note that asterisked items (*) are not applicable to Dedicated Server customers.

Illegal Use

TBS Web Design servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation—or that may directly facilitate the violation of any particular law or regulation—is prohibited. This includes, but is not limited to, copyrighted material; trademarks, trade secrets, or other intellectual property rights used without proper authorization; and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include pirated software, hacker programs or archives, Warez sites, MP3s, and IRC bots.

Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include, but are not limited to, the following: unauthorized access, use, probing, or scanning of systems’ security or authentication measures, data, or traffic; interference with service to any user, host, or network—including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resources*

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (depending on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a Dedicated Server plan. TBS Web Design shall be the sole arbiter of what is considered to be a high server usage level.

Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice. This includes accounts running services on ports higher than 80.

99.9% Uptime

If you are on a shared plan and experience more than 45 minutes of downtime in a month, you are authorized to receive a one-month credit, not to exceed one credit per month or $25 per month.

Uploaded Files (PPTClasses, TSPs, tools, guides, aids, etc.)

All TBS Web Design software is copyrighted. All files uploaded by the creator or author retain any expressed copyright and terms and conditions, and copyrights remain intact after uploading. The originator is assumed to have personally created the content and is assumed to be the author. By voluntarily uploading a file, you will be considered to be “donating” your intellectual property to TBS Web Design sites, including PPTClasses.com and Powerpointranger.com. Copyrighted material will not be accepted, and if discovered, will be immediately removed. Responsibility for uploading copyrighted material lies with the uploader; TBS Web Design is not liable. By uploading a file (classes, TSPs, etc.), you consent to its inclusion and distribution on our sites. Any expressly stated restrictions will be honored in all cases. All rights reserved.

CGI Scripts*

CGI script sharing with domains not hosted by Topsarge services—including TBS Web Design, TBS Performance, and TBS Research is not permitted. Any CGI scripts deemed to adversely affect server performance or network integrity will be shut down without prior notice.

User Level Security – 3rd Party Scripts & Passwords

You, the customer, are responsible for keeping your account secure at the user level. This includes, but is not limited to, any software you install, including software installed using the script installers we provide (such as Fantastico or cPanel script manager), as well as third-party scripts and passwords you create. You are required to regularly check for vulnerabilities and update third-party software as needed or as directed by Topsarge services—including TBS Web Design, TBS Performance, and TBS Research. We reserve the right to disable any script(s) posing a security risk or not updated as requested and may suspend your account entirely if necessary. TBS Web Design is not responsible for any adverse impact on your site resulting from script deactivation.

It is your responsibility to choose secure passwords, update them regularly, and manage them appropriately. TBS Web Design reserves the right to change insecure passwords.

Chat Rooms*

TBS Web Design does not permit customers to install their own chat rooms, as they generally require significant system resources. However, we do offer Java-based chat rooms that fulfill most users’ needs without compromising performance.

Background Running Programs and Cron Jobs*

TBS Web Design allows background programs to run using the cPanel Cron Job utility. Standard Crons are included, though additional charges may apply depending on system resource usage and maintenance requirements. IRC

TBS Web Design does not prohibit IRC or IRC bots, as long as they are not used maliciously.

Bulk Mail / UCE (Unsolicited Commercial Email) – SPAM

Bulk email of any kind—spam, opt-in, or double opt-in—is not allowed. If you wish to send a double opt-in list exceeding 1,000 addresses, you must request approval through our help desk beforehand. Sending spam or using another server to advertise a URL or email hosted with us may result in immediate suspension. TBS Web Design will determine what constitutes a policy violation. Our servers enforce a 200-emails-per-hour limit. The use of bulk mailing tools such as Constant Contact is encouraged.

Tech Support

Tech support is not unlimited. We reserve the right to limit support if usage becomes excessive. TBS Web Design will determine what qualifies as “reasonable.” Support exceeding typical levels may incur an hourly fee. We do not offer ongoing support for add-on domains, except initial setup. If a major issue arises with your account, we may opt to terminate and re-establish a fresh account instead.

Content that generates complaints, contains sensitive personal information (such as credit card numbers or SSNs), or promotes offshore bank sites or terrorist groups is prohibited.

Affiliates

To qualify for affiliate payments, customers must remain active with TBS Web Design for at least 45 days. Payments are issued by mail or credited unless stated otherwise. This applies only to new customers.

Payments (PPTClasses.com)

Payments are processed through PayPal, Stripe, Google Pay, and other processors, each with its own fee structures. By joining our sites, you agree to an annual subscription, which you may cancel at any time. If not canceled, the subscription renews automatically on your anniversary date. In the event of a declined or expired payment method, new information must be submitted within five days. Unpaid accounts may be suspended or deleted. Accounts over 30 days past due may be sent to collections and incur court/legal fees. TBS Web Design is not liable for overdraft fees.

Refund Policy (PPTClasses.com)

We offer instant access to downloads upon payment and guarantee 99% uptime. While we ensure listed files are available, we do not guarantee the content’s accuracy, completeness, or relevance. If you’re unsatisfied within 30 days, we’ll refund your purchase.

Cancellation (PPTClasses.com)

Members may cancel annual subscriptions at any time. Two-week renewal notices are sent if your email is current. To cancel, use your PayPal dashboard. Non-payment will suspend your account automatically.

Cancellation (Web Hosting)

All hosting plans are recurring. To cancel, contact TBS Web Design via our contact form, email, or phone at 254-231-3197. A confirmation will be sent within one business day. Cancellations after the 30-day money-back period incur a $50 termination fee and will be prorated. Domain registrations are non-refundable. We do not accept cancellations via chargeback or email alone. Chargebacks incur an administration fee equal to the chargeback plus $35, along with any applicable legal or collection fees.

Refusal of Service

Topsarge services—including TBS Web Design, TBS Performance, and TBS Research—reserve the right to refuse or terminate service at any time, for any reason or no reason.

Vulgar and Abusive Language

Use of vulgar or abusive language toward our staff, partners, or vendors will not be tolerated and may result in immediate account termination.

Copyright Violations

Unless stated otherwise by the author, all content uploaded to TBS Web Design (including via PPTClasses.com) is considered a donation and remains the property of the original author. Copyrighted material must not be uploaded without permission.

DMCA Policy

The Digital Millennium Copyright Act (“DMCA”) outlines the process for submitting a valid copyright infringement notification. If you believe your copyrighted work has been infringed upon, you may notify TBS Web Design by contacting our designated DMCA agent via one of the following methods:

To be valid under the DMCA, your notice must include the following:

• The Claimant’s full name, address, and phone number

• A statement, made in good faith, that the use of the material is not authorized by the copyright owner, its agent, or the law

• A statement, made under penalty of perjury, that the information in the notice is accurate and the Claimant is authorized to act on behalf of the copyright owner

Domain Registration and Renewals

Domains registered through TBS Web Design may be renewed anytime prior to expiration for up to a maximum of 10 years. While we make efforts to send reminders via phone and/or email, it is solely your responsibility to monitor and renew your domain(s) before they expire.

Failure to renew your domain may result in it being converted into a pay-per-click site containing images, links, and text selected by our parent registrar. By registering a domain with us, you acknowledge and accept that such content may be displayed. You also agree to abide by all rules, actions, and decisions made by the parent registrar during your registration and renewal period.

Domains expired for over 30 days may be unrecoverable or may incur additional recovery charges.

Upgrades

TBS Web Design performs regular server upgrades to enhance security, prevent known exploits, and maintain optimal performance. These upgrades may occur without prior notice.

We are not responsible for incompatibility issues, script errors, content malfunctions, missed or failed deliveries, or data loss following an upgrade.

By using our services, you agree to indemnify and hold harmless milMedia Group from any claims or damages resulting from such use. Services are provided on an as-is, as-available basis without any warranties, including but not limited to:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

TBS Web Design disclaims liability for data loss, misdelivery, service interruptions, or errors. No verbal or written advice from our team creates any warranty. You may not rely on such communications for any guarantees.

If your actions result in legal action against TBS Web Design, you agree to cover all associated costs, including settlements, judgments, attorney’s fees, and legal expenses.

Modifications

TBS Web Design reserves the right to modify, add, or remove any portion of these Terms of Use at any time, without prior notice.

Actions Taken by TBS Web Design

Failure to comply with any part of the Terms of Use may result in immediate account suspension or termination. TBS Web Design is the sole authority in determining violations.

We reserve the right to deactivate or remove any account without warning. Upon learning of a potential violation, we will investigate the matter and may temporarily restrict access to prevent further harm.

Depending on the severity of the situation, we may:

• Restrict or suspend services

• Permanently terminate the account

• Pursue civil remedies

• Notify law enforcement if criminal activity is suspected

TBS Web Design does not issue service credits for outages resulting from violations of our Terms of Use.
